Objective:

To establish a document that could possibly allow a business / crafter to be able to acquire a licensing agreement for an upcoming Minster Oktoberfest event whereby said business / crafter may be able to utilize the names Minster Oktoberfest, Oktoberfest Minster, Ohio, or any variation of these names on merchandise that has been approved by the Minster Oktoberfest Board.

Affects:
Any business / crafter who would like permission to utilize the registered names Minster Oktoberfest, Oktoberfest Minster, Ohio, or any variation of these names.

Form Availability:

The Minster Oktoberfest Trade Name Application form will be made available on the Minster Oktoberfest web page.

Form Submission:

Form must be completed, a $100.00 Trade Name Use Fee, and a picture of each of the items that a given business / crafter would like permission to produce that would utilize the names Minster Oktoberfest, Oktoberfest Minster Ohio, or any variation of these licensed names for consideration must be mailed to the address listed on the form.

Approval of the form for the licensing agreement is contingent on:

1. Proper information being submitted on the form in question.
2. Completed forms having been submitted on or before May 1, 2024.
3. Quality and content of the items shown in the attached pictures.
4. The approval of said items by the Minster Oktoberfest Trade Name Committee.
5. The Minster Oktoberfest Trade Name Committee reserve the right to deny the use of the Minster Oktoberfest, Oktoberfest Minster Ohio, or any variation of these licensed names based on Item’s:
6. Style, 
7. Content
8. Appropriateness
9. Similarity to other items already approved or being manufactured by others.
10. Or for any other reason given by the Minster Oktoberfest Trade Name Committee 
11. If denied, the $100.00 check for the Trade Name Use Fee will be returned to the business / crafter / Person who submitted the form.

Once Approved:

1. Minster Oktoberfest Trade Name Committee will arrange a meeting to discuss the following:
2. Sales price of the item to ensure it is comparable to sales prices in Das Button Haus
3. ____% of Gross net profits gain from the sales of the approved items agreed upon by both the Grantee and the Minster Oktoberfest Trade Name Committee. 
4. The Trade Name Use Agreement Form will need to be filled out and signed by both the Grantee and the assigned Minster Oktoberfest Trade Name Committee member.
5. Licensing agreement is only good for:
6. The year that the form / contract is approved.
7. The items specified on the form / application that were approved by the Minster Oktoberfest Trade Name Committee. 
8. These approved items can only be sold in the year that the licensing agreement is granted for the items approved.
